- The purpose of this study is to determine the implementation of the obligation to provide burial land by housing developers in Malang regency, and the action against from goverment of Malang regency for developer who do not do the obligation. This study uses sociological juridical method consisting of primary data that is interviews and observsation, secondary data obtained from normative provision, textbook, document/files, opinion of scholars and journal of law. Data collection techniques in the form of interviews, observation, document and documentation, and then analyzed descriptively qualitative. Based on the results of the study there are developers who provide cemeteries with an exact area of 2% and above 2% of the total area of residential land. There are also developers who have not yet provided burial grounds, but have carried out the construction and sale the homes without permits, such as Site Plan and Building permit by using a deed of purchase agreement. Submission of burial ground to local goverment is not done because there is no payment made by funeral provider. The action against for the developers who do not do the obligation is just a written warning. Recommendation from the authors is required Detailed Spatial Plan starts from the village, and is needed more clearly action against by the local government for developers who do not implement it.
