- The authority to investigate the Narcotics criminal case is handled by two institutions. Basically, the investigation authority of each investigator has no difference related to the object of investigation. The law has not yet divided the narcotics and narcotics precautions which should be handled by the investigators of the Indonesian National Police and the National Narcotics Agency investigators. This has the potential to lead to overlapping of authority and to fight over power in handling narcotics crime cases. This research takes the formulation of the problem 1) What is the basis of setting the authority of the investigation of Narcotics Crime by the Batu City Police Resort and BNN of Batu City? 2) What are the constraints faced by Batu City Police Resort and BNN Batu City in carrying out the authority of the investigation of Narcotics Crime? 3) What is the need for synchronization and harmonization of regulations to overcome the overlapping by the police investigators of Batu City Resort and BNN Batu City? The method of research in this paper is to use the type of sociological juridical research is research that focuses on the rule of law (das sollen) and combined with reviewing the social facts (das sein) as the primary legal material. While the secondary law material comes from books and journals. Then data in research is analyzed descriptively qualitative. Based on the result of research that the regulation of investigation authority by Police and BNN is regulated in Article 81 of Law No.35 Year 2009 on Narcotics. Police investigators and BNN Batu City find external and internal constraints in conducting investigations. Therefore, the need for synchronization and harmonization of laws related to the enforcement of investigation and investigation of narcotic crime and coordinate more closely between the Police and BNN Batu City. Against the community is also expected to participate in the prevention of narcotics crime.
