- Legal force of SHM as sign of land ownership rights stated on Pasal 32 ayat (1) and (2) PP Pendaftaran Tanah provide protection to SHM Holders with good faith and provide deadline of lawsuits in five years, but Putusan MA RI Nomor:1761 K/ Pdt/ 2014 decided contrary with Pasal 32 ayat (2) PP Pendaftaran Tanah. The writer’s formulation of problem are: The Dictum and Consideration of Putusan PN Jakarta Pusat nomor: 220/Pdt.G/PN. Jkt. Pst aborted by Putusan PT Jakarta Nomor: 318/ Pdt/ 2013/ PT.DKI, then the dictum and consideration of Putusan MA RI Nomor: 1761K/PDT/2014 that reinforce Putusan PT Jakarta Nomor: 318/ Pdt/ 2013/ PT.DKI about Legal force of SHM as sign of land ownership rights in perspective of legal certainty, Justice, and legal expedience. Writer uses juridical normative approximation method and primary legal material contains the related verdict, secondary legal material contains related law and books, tertiary legal material contains supporting dictionary. The results, dictum and consideration of Putusan Pengadilan Negeri Jakarta Pusat aborted by Putusan Pengadilan Tinggi Jakarta has given a legal certainty, justice, and legal expedience about legal force of SHM as sign of land ownership rights. Contrary the dictum and consideration of Putusan MA RI that reinforce Putusan Pengadilan Tinggi Jakarta Legal force of SHM as a sign of land ownership rights hasn’t given a legal certainty, justice, and legal expedience. MA hopefully can publish a SEMA about interpretation and enforcement of goodfaith and deadline of lawsuit in Pasal 32 ayat (2) PP Pendaftaran Tanah.
