- This research of law is entitled “Implementation of Regulation of the Minister of Finance No. 130/PMK.010/2012 on Registration of Fiduciary Guarantee for Consumer Financing Company that implements fiduciary collateral for motor vehicles”. In addition, the background of the research of the law under the title is that the number of finance companies which carries out consumer financing which includes the imposition of a fiduciary guarantee but does not register the fiduciary guarantees in a timely manner to the Fiduciary Registry Office but when the financing considered to be stalled. In other hand, the appearance of creditors who have the preferential rightful authority and executorial rightful authority as well that is when the fiduciary guarantee was registered. Due to the existence of a finance company that does not register fiduciary it also resulted as country losing income from Penerimaan Negara Bukan Pajak (PNBP). Moreover, this research of law aims are to find out the implementation of fiduciary guarantee through electronic system in PT. Mandiri Utama Finance Branch of Mojokerto and to know the supporting or inhibiting factors of PT. Mandiri Utama Finance Branch Mojokerto in conducting registration of fiduciary guarantee through electronic system in accordance with the procedure. To support the implementation of Regulation of the Minister of Finance No. 130/PMK.010/ 2012, then appears Government Regulation Decree of Procedures for Registration of Fiduciary Guarantee and the Making of Fiduciary guarantee certificate No 21 of 2015. This research uses a sociological juridical approach, which sees the law as human behavior in society and linked to existing rules and also legal sources related to the case to be studied.
