- Cohabitation is an act of living together between men and women without bound by legitimate marriage. Where this act is an immoral act for the people of Indonesia, only in some areas that allow cohabitation. This act is a social reality that can create problems. Thus, the government filed the Criminal Code draft on cohabitation in article 488 of the draft Criminal Code. In the discussion of this thesis the authors raised the issue of what is an indicator of living together as husband and wife in Article 488 of the draft Criminal Code. Writing this thesis using legal approach juridical normative with the technique of collecting literature study materials. Based on the results of the study, this article has not provided the fulfillment of clear criminal elements of this article. The expectation of the formulation of clear elements in this article cohabitation to be in accordance with the purpose of the establishment of the article.
