- The forms of child crime are more structured and for the nuance that growing and tech child who are involved in crime sometimes have to go through legal process, and often they are sentenced to imprisonment. Law enforcement apparatus rarely use non-legal channel that led to criminal prosecution. This research takes the formulation of the problem Is The Sanction Implementation Policy (Crime/Action) Reflecting the Protecting of Child Criminal Actors and How the application of restorative justice through the diversity system to the settlement of crime committed by the child in the Malang District Court. This research used sociological juridical method, primary data source obtained from the field and secondary data from newspapers, magazines, research journals, internet, library and data collecting techniques in the forms of interviews of respondent who come from judges and direct observation to research location in Malang District Court. Then, data of research result analyzed by descriptive analysis. Based on a case study of children who entered the Malang District Court in 2016-2017 recorded 20 cases. 6 cases succeeded in diversion, 7 cases of imprisonment, 6 cases in the form of on the job training and coaching, 1 case returned to the parents. The conclusion, judges tend to give criminal sanction against bad children rather than giving sanction in the form of action, as well as diversion effort have been done quite well.
