  • The development of banks is still maintained with improved performance supported by increased profitability (the ability of companies to generate profits). In addition, the adequacy of capital and liquidity is still sufficient despite the rising credit risk. Many societies have no other option, beside guaranteeing the deed of sale and purchase to meet the economic needs and the Bank receives guaranteed collateral for the credits submitted by the societies. Statement of the problems; 1. How the practice of guaranteeing the deed of sale and purchase of land rights at the branch of Bank Jatim Kediri seen from the Law no. 4 1996 on the Right to KPR? 2. Supporting factors and obstacles faced by Bank Jatim Branch Kediri about the practice of guaranteeing the deed of sale and purchase of land rights? The research method is sociological juridical which takes primary data obtained from field observation and secondary data obtained from documentation and legislation. From the results of research could be seen that the guarantee of deed of sale and purchase of land rights conducted in branch of Bank Jatim Kediri not in accordance with law number 4 concerning Reality. However, the Bank of East Java Kediri have their own policy that allows the deed of sale of land rights could be used as collateral in applying for credit, where the bank will use the Notary-PPAT service to be able to overcome the problems by helping both parties to realize the goals of each party without there is a loss from the customers or from the Bank. In credit management, banks will assist customers in the manage their certificates. Thus, it is expected that banks are more cautious in approving customers who apply for credit with the guarantee of the deed of sale of land rights, preferably the banks pay more attention to the existing regulations.
