- The existence of underage recidivists in Class I Penitentiary Institution of Malang has proved that nowdays, the delinquency of children has a tendency to make them repeating criminal acts more than once. This study discusses about the factors that affect the children to be a recidivist and the method of empowering underage recidivists in Class I Penitentiary Institution of Malang. This study uses sociological juridical approach method with primary data from underage recidivism population which consist of 3 people and secondary data from book and legislation. These data analyzed by using qualitative descriptive method. Based on the results of the study of three people sample, it can be seen that the factors that affec children to become residivis in Class I Penitentiary Institution Malang caused by individual factors in terms of external factors in the form of history education, soiety and responsibility of life. In terms of juvenile delinquency factors there are indication that the misbehaviors of children are caused by physical condition, family condition and neighboring conditions
