- The child of the perpetrator of the crime must remain protected and cared for their rights so it is not to interfere with or even damage the child's growth period. Provides protection for children who are in conflict with Indonesian law as a country that is in favor of the Convention on the Rights of the Child as further set forth in Law Number 11 Year 2012 on the Criminal Justice System, the rule reveals the general principles of child protection, protection, justice, non-discrimination, the best interests of the child, the survival and growth of the child, the deprivation of liberty, the avoidance of reciprocity and respect for the participation of the child. Solution in handling of child crime case that is with approach of restorative juctice, which is executed by way of Diversion. Diversion is a child's right that must be fulfilled by the investigator in the settlement of the child's case. Then what are the considerations and constraints of the investigators in the implementation of Diversion. This writing uses research methods of observation and interview. The consideration of the investigator in the implementation of the Diversion is, the child who still needs the education that they should be receive in their age. Then a child who still does not know what they are doing is against the law and has sanctions. Constraints faced by the investigator in the implementation of the Diversion is, the parents and or guardian of the victim who is hard to accept the existence of Diversion and still want the child perpetrator sentenced to a worthy penalty. Furthermore, people who are less assure in the existence of Diversion are driven by the sense of resentment against the child perpetrator, so that the child perpetrator according to the them should be sentenced to criminal punishment.
