  • Article 5 Paragraph (1) of the Press Law states that "the national press in broadcasting information, does not judge or make conclusions of wrongdoing, especially for cases that are still in the judicial process and can accommodate the interests of all parties concerned in the news. Daily Radar Malang and Kompas Daily Malang does not apply the provisions of Article 5 paragraph (1) of the Press Law well. The formulation of the problem in this study is as follows: (1) How Effective Article 5 Paragraph (1) of Law Number 40 Year 1999 About the Release Related Principle of Presumption of Unlawful Presumption in Criminal Case Reporting By Editor in Chief and (2) How legal implication if publication of criminal case by editor in chief contrary to the principle of presumption of innocence. This research uses juridical empirical research with a sociological juridical research approach, as well as using primary data sources and secondary data sources. The conclusions of this study are (1) Article 5 paragraph (1) of the Press Law related to the application of the principle of presumption of innocence in the publication of criminal case by journalist still cannot be implemented effectively and (2) legal implication of criminal publication which violate the principle of presumption guilty by journalists is the duty to give the right of reply proportionately in an effort to restore the good name of the party who feel harmed.
