- Suspension of detention is the suspension of the suspect / accused from detention, but detention is still valid and official. Suspension of detention consists of suspension of detention with the guarantee of persons and the suspension of detention with money guarantees. Suspension of detention may be filed at the investigation, prosecution and trial level. Thus, the author wanted to know the comparison between the two suspension of detention. Discussion of this essay the writer raised the problem about how the implementation of suspension of detention with the guarantees of people, how the suspension of detention with money guarantees, as well as obstacles in granting the second request suspension of detention. In this study the author uses the approach Sociological Juridical. Using primary data types by interviewing and secondary data by looking at the internet. Based on the results of the study, the suspension of detention with the guarantee of people is more commonly used in the Police of Sidoarjo because it is simpler and easier, while the suspension of detention with money guarantees is rarely used, as it sees from the economic condition of the accused or the defendant. Obstacles in granting detention penangguhanan different in each implementing agency. Updating the rules is necessary to address the problems that exist in the implementation process of suspension of detention.
