- A prisoner undergoing guidance in a Penitentiary means giving up his or her independence to the Penal Institution. However, in carrying out such guidance, Penal Institution must pay attention to all relevant laws. As a state of law, coaching should also take into account the rights of an inmate. One of the prisoners' rights is the permit out of the Penitentiary in exceptional terms. The extraordinary thing is regulated in Article 52 paragraph 1 letter (b) according to Government Regulation No. 32 Year 1999 in Class I Correctional Institution of Madiun City. This research uses sociological juridical method and conducted by head interview method of coaching in Penitentiary. The research was conducted at Penitentiary of Class 1 of Kota Madiun because there was an ex-prisoner of Penitentiary of Class 1 of Kota Madiun who had obtained permission from Penitentiary Institution in extraordinary matter without procedure because of close relationship with the officer. So the problem in this research is the mismatch between the law and the facts in the field. The results showed that Classification Correctional Institution 1 of Madiun City had given permission to the prisoners who filed and had to meet the conditions dependent on the conditions experienced by the inmates. While the obstacles faced in granting permission to exit Penitentiary Class 1 of Madiun City is the lack of socialization between out Correctional Institution with the relevant agencies so that when the prisoner will apply for permission, experiencing complexity in proposing the terms. The second obstacle is the nonjjectivity of the Class 1 Correctional Officer of Madiun City that misappropriates the granting of outside permits from the Penitentiary because of the close relationship with the prisoner, thus violating the principle of equality in the guidance
