- Research from the Indonesian Child Protection Commission (KPAI) shows that illegal marriages are accessed by the top five factors causing Indonesian child neglect. The state provides a solution to isbath and the determination of the origin of children, children outside of marriage in order to get recognition by these people are one of the breakthrough efforts to save children born from marriage under hand. In fact, not all courts have granted the request for the origin of the child as the case Number: 0136 / Pdt.P / 2016 / Pa. Kab. Kdr. The decidendi ratio of judges on freedom uses article 3 paragraph (2) and article 4 of the marriage law number 1 in 1974. This decision has serious implications for children from these implications, namely children in the eyes of the law, prone to discriminatory treatment in family and social environment, basic rights of children such as birth certificate and affection are not fully fulfilled.
