  • The role of an advocate as a free and independent law enforcement is guaranteed by law and legislation to be very important in the law enforcement process. Through legal services provided by both paying and underprivileged clients is the same in terms of treatment but in reality it is still rarely advocate to provide legal aid to the community is not capable, especially in civil disputes How the implementation of advoiat in providing legal assistance free of charge only to the community is not capable in particular in sengkete keperdataan. What factors are the obstacles of advocates in providing legal aid only to the community is not able especially in civil disputes? This study uses the method of Juridical Sociological Approach, with the location of research at the Office of Legal Aid Institute of Malang City Type of data used is the primary data obtained from the field and secondary data from legislation, primary data collection techniques obtained from interviews and secondary data obtained through library studies and tracing legislation. Analyzed using qualitative descriptive techniques. Based on research obtained from 5 resource persons at Advocate Office of Legal Aid Institute of Malang City, as for the result of research that still lack of handling done by Legal Aid Institution in giving legal aid free of charge to society is not capable especially keperdeataan and there are 6 factoryamg influence one of them is lack socialization from advocates to the community.
