- Divorce is the broken marriage between an husband and wife because disharmony in household or something else happens. In Chapter 39 number (1) Contitution Number 1, 1974 about marriage, it is regulated if the divorce is only happened in front of Cout Trial after the Trial does mediation for both sides. In this mediation, it is not successful. Simple in the clear way, it is easy to understand. Fast means lead to the process of trial. Chep cost means the burdening coat and everyone can pay it. This question of this research : 1. What are the steps in finishing the divorce affair in The Religion Cout of Malang? 2. How to applicate the principle of simple, fast and cheap cost is finishing the divorce affair in the Religion Court of Malang? 3. What are the supporting and obstructing in applicating the principle of simple, fast, and cheap cost to finish the divorce affair in the Religion Court of Malang? In this research, the writers used a sociological judicial method with the subject of research is the judges, clerks and justice seekers in the Religion Court of Malang. The data taken with observation, interviews and reports documentation, them the data analysis is qualitative descriptive analysis. In general, the application of principle of simple, fast and cheap cost in divorce affair is still less of success. The obstructions came from both employees and divorcing ride. One of the suggestion is to increase this application, it is requires the professional judges and clerks
