  • In the Agrarian scope, land is part of the earth called the surface of the earth. The juridical understanding, namely what is called land rights is a part of the earth where people can use and make the best possible use of it without violating exiting regulations in Inonesia. While settlements are part of a residential environment consisting of more than one housing unit that has infrastructure, public utility facilities, and has supporting other function activities in urban areas or rural areas or villages. The use of railroad bordser areas as residential areas will obviously disrupt the smooth transportation of trains. Transportation is very much needed in supporting the movement of the population. Border line is a security boundry line that is drawn at a certain distance parallel to the edge of the river, the edge of the channel, the foot of he embankment, the edge of the lake, the edge of the reservoir, th edge of the spring, the edge of the fence, the edge of the buikding, and the oil and gas pipeline network which is the land boundry that may be permitted. And may not build buildings or carry out activities. The prohibition of establishing settlements in the railroad border area, there is already a law that regulates it, namely Article 178 of law No. 23 of 2007 concerning railways, but the problem is the lack of understanding for the initial owner of article 178 many illegal settlements have been set up along the railroad tracks. The land is owned by PT KAI and serves as a protection for railways body from damage to totta disturbances as reserve for future development.
