Tinjauan kompilasi hukum ekonomi syariah terhadap lifetime garansi pada produk tupperware

- INDONESIA: Pada jaman sekarang banyak cara yang dilakukan penjual untuk menarik minat para pembeli, salah satunya dengan jaminan atau yang biasa dsebut dengan garansi. Garansi juga memiliki beberapa macam, pada saat ini dikenal bentuk garansi yang baru yaitu lifetime garansi atau garansi seumur hidup, akan tetapi jarang sekali suatu perusahaan memproduksi barang dalam kurun waktu yang lama. Ranah hukum Islam juga mengatur bahwa perjanjian harus jelas dan didasari kerelaan serta memenuhi syarat dan rukun. Pada penelitian ini terdapat rumusan masalah, yaitu: 1) Bagaimana mekanisme mendapatkan lifetime garansi dalam klausul lifetime garansipada produk plastik Tupperware, 2) Bagaimana tinjauan Kompilasi Hukum Ekonomi Syariah terhadap mekanisme lifetime garansi pada produk plastik Tupperware. Tujuan dari penelitian ini, yaitu: 1) Untuk mengetahui mekanisme mendapatkan lifetime garansi dalam klausul lifetime garansipada produk plastik Tupperware, 2) Untuk mengetahui tinjauan Kompilasi Hukum Ekonomi Syariah terhadap mekanisme lifetime garansipada produk plastik Tupperware. Penelitian ini masuk dalam kategori penelitian hukum normatif karena menggunakan bahan-bahan kepustakaan sebagai sumber data penelitian. Penelitian ini menggunakan pendekatan komparatif. Dalam penelitian ini, metode pengolahan bahan hukum dilakukan secara kualitatif. Dalam penelitian ini, peneliti mengolah data yang didapat dari klausul lifetime garansi pada produk Tupperware untuk menjelaskan pengertian dari lifetime garansi dan menganalisa menggunakan Kompilasi Hukum Ekonomi Syariah. Hasil dari penelitian ini terdapat 2 kesimpulan, antara lain: 1) mekanisme lifetime garansi Tupperware, yaitu: a) Pembeli datang ke kantor distributor, b) Staff distributor akan meneliti apakah barang yang diklaim masuk dalam ketentuan lifetime garansi, c) Proses penggantian barang defektif reguler dan defektif non reguler. 2) Kompilasi Hukum Ekonomi Syariah bab X Bagian Keempat Pasal Tentang Khiyar ‘Aib dan klausul lifetime garansi Tupperware, terdapat tiga poin yang dapat peneliti analisis, yaitu akad, subyek, dan obyeknya. Serta terdapat lima perbedaan dan empat persamaan ENGLISH: Nowadays, sellerstry manythings to attract customers, such as offering product warranty which has various types. The recent one is a lifetime warranty. Yet, only a few companies makelong termproducts. Islamic law system regulates the transaction to have a clear agreement based on the will of both parties and also to fulfill the Islamic laws and principles. The research problems of this research are: 1) How is the mechanism to get lifetime warranty in the clause of lifetime warranty for plastic products of Tupperware, 2) How is the review of the Compilation of Islamic Economic Law toward mechanism of lifetime warranty for Tupperware plastic products. The purposes of this research are: 1) To find out the mechanism to get lifetime warranty in the article of lifetime warranty for Tupperware plastic products, 2) To find out the observation of the Compilation of Islamic Economic Law toward lifetime warranty mechanism of Tupperware plastic products. The study is a normative law research because it uses library sources as its reference. It uses comparative approach. In this research, the method of law materials process is qualitative. The researcher processes the collected data from lifetime warranty clause of Tupperware products to explain the term of lifetime warranty and analyze themusing the Compilation of Islamic Economic Law. The results of this research have three conclusions. They are: 1) The mechanism of Tupperware lifetime warranty: a) the customers come to the distributor office, b) the staffs will observe the product claimed whether it is categorized as lifetime warranty, c) the replacement process of regular and irregular defective products. 2) From the Compilation of Islamic Economic Law chapter X subchapter 4 concerning Khiyar ‘Aib and Tupperware’s lifetime warranty clause, theresearcher analyzes their agreements, subjects, and objects. In addition, there are five differences and four similarities between the compilation and the clause.
