- In the current era of health development, pharmacy plays an important role to meet the consumer’s need for medicine and health equipment. For that reason, the government always controls the establishment of pharmacy because it is one of the businesses to supply medicine to the consumers. The relationship between a pharmacist as the manager of a pharmacy and the investor is not an employeremployee relationship but an equal work cooperation which means they have the same position in the pharmacy business either in terms of loss, management or profit sharing. This normative juridical study looked at anything related to the work agreement a pharmacist and the pharmacy owner by analyzing the problem based on regulations of legislation, theories, and concepts related to the aspects of agreement law. The data used in this study were primary data which were directly obtained through questionnaires and interviews, and the secondary data in the forms of library study. The data were qualitatively analyzed after being scrutinized, grouped, processed, and evaluated to obtain their reliability. The agreement between a pharmacit and the pharmacy owner has a balanced rights and responsibility which have been well implemented that the implementation of rights and responsibility of the pharmacist and the pharmacy owner have resulted in mutual responsibilities between both parties. The responsibility of the pharmacy owner is only to provide the facility and infrastructure to establish the pharmacy and the responsibility of the pharmacist is to manage the pharmacy and be responsibility for the consumers. If the pharmacist fails to perform his responsibility, the consumers can claim for compensation. The dispute existing between the pharmacist and the consumers, in general, will be settled through deliberation. The settlement of dispute between the pharmacist and the pharmacy owner can be done in or outside of the court of law. But the parties involved prefer settling the dispute outside of the court (deliberation and mediation) to in the court.
