- State-Owned Enterprises play an important role in running national economy in order to realize the people’s welfare. State-Owned Enterprises are regarded to have strategic role in fostering and developing small businesses and cooperatives. The government, through is regulations, has entrusted State-Owned Enterprises to participate in helping the government implement the development policy which has been outlined. This case has become the underlying idea to conduct the research by answering the problems: how is the management of the credit agreement in the partnership program of the State-Owned Enterprises with small businesses? How is the implementation of the credit agreement of partnership program loan between PT. Jamsostek (Incorporated), Medan, and its fostered partners? And how is the handling of the obstacles of paying up the installment of the partnership loan of PT. Jamsostek (Incorporated), Medan? The method of the research was legal normative, and the judicial normative approach was conducted only on the relevant legal provisions being studied; in other words, the law was viewed from normative aspects. The secondary data were collected by using interviews with the Head of Special Program Sector of DPK and KBL Jamsostek (Incorporated), Medan. Based on the result of the research, it was found out that the procedures and the implementation of fastering small and medium businesses and cooperatives, conducted by PT. Jamsostek (Incorporated), Medan, had been in accordance with the legal provisions, along with the requirements for mortgage in giving the loan which was stipulated in the internal regulations. The form of the agreement was not before a notary. PT. Jamsostek (Incorporated), Medan, had given the loan to micro, small and medium businesses selectively. The legal force in the credit agreement of partnership program was stipulated in the standard Letter of Credit Agreement, whereas the effort of PT. Jamsostek (Incorporated), Medan, in handling the obstacles of paying up the installment was by sending letters of overdue payment and by fostering because the aim of doing them was to help the people who lived in the surrounding of the company. In the case of default, the solution was to refer to the procedures which existed in the agreement.
