In Vienna Convention 1961, Diplomatic Agent have immunity to do and complete his/her job in the receiving state. Although diplomatic agents already granted with an immunity to the jurisdiction of the courts of the receiving State, the immunity can be uninstalled or removed by the sending State using the demands of the receiving state. The problem is, what are the factors of the receiving State to demand an immunity waiver of the diplomatic agent. And how this case impact the diplomatic relations between the receiving State and the sending State on the action of this immunity waiver to diplomatic agents of the State. Immunity waiver is an efforts to resolve the case of diplomatic agent who commit violations in the receiving State. This study aims to find out what factors requires the receiving country to demand an immunity waiver against diplomatic agent and how it impacts the diplomatic relations of the two state. The method used in this paper is a normative juridical or Literature study and Qualitative Analysis. The results from this study is, there are several factors that can affect the receiving country in demanding immunity waiver such as criticisms and demands of the various sides of the society to the government, The most important factor is a strong desire to maintain good relationship between that two countries, and will improve the diplomatic relations of the two countries where there was some critics, where there was criticism and demands from various sides of the society to the government. Further, it also define the main purpose of the diplomatic immunity to diplomatic agents as in the Opening of Vienna Convention 1961.
