  • Humans as labor must get protection, welfare and calm, security in carrying out work relations because humans face uncertainty. The government requires that migrant workers must be legal, sent through official agents. There are still many Indonesian Workers who work overseas without a visa to work as illegal TKI without the social security they have. This is due to economic factors to finance kelurganyah in the village. Based on Banten News, as many as 271 Indonesian Workers (TKI) have problems and have not been able to be returned to their homeland during 2017. The number is dominated by the attacking regency which reaches around 200 cases. Based on this number, Serang Regency is the biggest bag of troubled TKIs. There are still many forging migrant workers who do not get social security workers. This can cause problems, because labor has no protection when these workers get into trouble in the country where the workforce works. So it is necessary to examine how the protection of social security systems for TKI workers based on TRANS PERMENAKER Number 7 of 2017 concerning Indonesian Workers' Social Security program and how the legal consequences for those who do not have employment social security programs based on TRANS PERMENAKER Number 7 Year 2017. Research methods in compiling This thesis uses a normative juridical type and descriptive analysis approach. The data used are secondary data and primary data as supporting, document study data collection techniques. Analysis of the data used in the study is qualitative analysis. The results of the study show that the protection of the implementation of a social security system for TKI workers is an obligation that must be owned by each TKI that must be provided by the Government. As a result of the law for migrant workers who do not have a social security workforce that will harm themselves and of course BP3TKI will always be blamed. In this case the Minister of Manpower and Transmigration has no strict sanctions regulating it. Keywords: Social Security, Labor, Minister of Manpower and Transmigration Regulation No. 7 of 2017
