- The Presidential advisory council is a state’s support organ, who carries out the function of presidential advice. Actually the function of advisory has already exist since Constitution of Republic Indonesia authorized. The advisory organ has encountered changes during the time of its existence. Aside of this advisory organ, there’s another organ that one of their duty as an advisor either. Article 17 of the Law No. 19 Of 2006 on the Presidential advisory council dedicates, an organ that own a same function should be removed. In this research, the author interested to observe the standing and function of Presidential Advisory Council. This research is using juridical normative methods, and description analytics specification. The sourced data used is secondary data which is obtained from Constitution of Republic Indonesia, another official documents, books which is related, a researches, an essay, thesis, dissertations, and regulations which is related. The result of this research shows that Presidential Advisory Council stands as a state auxiliary organ under the Presidency. Presidential Advisory Council has a function to proactive giving advices if it’s requested or not related to fundamental issues, strategic issues, and currently issues. The differences of support by another organ except of Presidential Advisory Council is they’re counsel according to implementation of President’s instructions, but Presidential Advisory Council advise an interpretation a contrario on their counsels, and autonomous without President’s instructions.
