  • The Social Service is an implementing element of government affairs in the social sector which has the main task of carrying out regional government affairs in the social sector, including the social welfare of orphans. This responsibility is explained in the Regional Regulation of Serang Regency Article 8 Number 5 of 2014. The problem that arises for the Social Service of Serang Regency to carry out the responsibility of organizing orphan welfare guarantees is the limitation and decrease in the budget, so that in its implementation not everything can be implemented. The problem identification in this research is How is the responsibility of the Social Service of Serang Regency in the implementation of social welfare guarantees for orphans based on the Regional Regulation of Serang Regency Number 5 of 2014 concerning Guaranteeing the welfare and protection of orphans and orphans in Serang district? and How are the obstacles faced and problem solving faced by the Social Service of Serang Regency in the implementation of social welfare guarantees for orphans in the Regional Regulation of Serang Regency Number 5 of 2014 concerning Guaranteeing the welfare and protection of orphans and orphans in Serang district?. The theories used in this research are Responsibility Theory and Social Welfare Theory. The method used in this research is empirical juridical with descriptive analysis research specifications. The data sources used are primary legal materials, secondary materials and tertiary legal materials. The results of this study state that the Social Service in the responsibility of guaranteeing the welfare of orphans is not running properly due to many factors as obstacles, one of the main factors is the absence of follow-up data on the number of orphans and orphans throughout Serang Regency. The conclusion of this research is that the Social Service of Serang Regency has an obligation to implement the social welfare of orphans based on the Regional Regulation of Serang Regency Number 5 of 2014. Suggestions from the author are that there needs to be synergy carried out with other Departments regarding follow-up data on the number of orphans and orphans throughout the district and create a special team to be able to coordinate regarding the provision of compensation so that they can find out what orphans and orphans need and so that the distribution of compensation is right on target.
