- Notary is a term used for identifying a group of people by the public authorization (openbaar gezag) that is promoted and authorized to establish written evidence of the authentic certificate. The position of Notary is the position in which the existence is expected by the State in order to realize the Law certainty upon the civil interaction. The Notary position is a public position. The society puts the trust to the Notary as the public officer competent of establishing the authentic certificate. As the consequence, the Notary position is executed by considering the prestige level / position that needs moral responsibility and integrity of the Notary. The violations relating to the ethical code of notary are the deeds or actionconducted by the members of the organization of Indonesian Notary Union oother people holding and executing the position of notary, violating the terms of th ethical code and/or organizational discipline. Based on those matters, therefore, the problems that will be observed in this research are : How is the execution of lawful protections for the Notary by the Regional Supervisory Council and Notary Organization (Indonesian Notary Union / Ikatan Notaris Indonesia) in case of positional sanctions are applied to its members and how notary public responsibility in the case of code infringement etik.Based on the research results, it can be concluded that the Notary experiencing positional sanctions in form of verbal reprimands, written eprimands, temporarily dismissed, dismissed with honor and dismissed with dishonor may perform lawful efforts in form of self-defense and administrative appeals.The Notary experiencing positional sanctions does not receive lawful protections from the Regional Supervisory Council because it only has thefunction of supervisor and observer; however, for the Notary experiencingpositional sanctions receives lawful protections from the Notary Organization(Indonesian Notary Union) as long as that Notary is still active as the member of organization. The responsibility of a notary, in the case of there is a violation of ethical code, is that, organizationally it takes effect when a notary makes a violation on the professional ethical code as the guidance created by the professional organization
