  • Implementation of the application of criminal sanctions against the perpetrators of the abuse of a minimum fine of narcotics basically aims to provide a deterrent effect on drug users was that the user is no longer using drugs after they finish serving a sentence imposed by the judge. This study aims to : 1) describe the implementation of a minimum penalty of criminal punishment in criminal narcotics under Law No. 35 of 2009 on narcotics in West Jakarta District Court and 2) Describe propsek minimum penalty sentencing in criminal narcotics under Law No. 35 of 2009 on narcotics in West Jakarta District Court. The research was conducted in the area of West Jakarta District Attorney Law. The method used is qualitative research with normative juridical and empirical approach using data collection techniques, namely the study of documentation, interviews, and observations. Basic theory used in this penelitiam are theories State of Law (grand theory), Theory of Law Enforcement (middle Range Theory) which contains the structure, substance, and the effectiveness of legal culture and legal theory (applied theory) which includes legal, law enforcement, means and facilities, community and culture. The results of the study can be explained that the implementation of criminal penalties and the prospect of minimum sentencing in criminal narcotics under Law No. 35 Year 2009 on Narcotics in West Jakarta District Court with application specific minimum penalty is minimal fines for criminal narcotics expected deterrent effect is very ineffective. This is evidenced by data analysis convicted of narcotics in West Jakarta District Attorney of the Year 2013 to November 2014 of the number of convicted 2.388 people, no one else who carry criminal penalties, they would prefer a replacement penalty is imprisonment. Thus not achieved the goal of providing a deterrent effect of punishment specifically for the doers.
