- Marriage is a valuable act of worship with the aim to establish harmonious family, Sakinah, mawaddah and warahmah and to give birth to offspring. However, not all marriages produce offspring that would become the heir of his parents. To get the children, various methods are used by couples as adoptions. Adoption and adopted children, including part of the substance of the legal protection of children who have become part of the law that live and thrive in the community. This type of research used in the preparation of this manuscript writing besides using normative juridical research method is also used juridical empirical methods. While the approach used is the approach of legislation (statute approach) and approaches the case (case approach). In the approach to reviewing legislation related regulations adoption among others: 1917 in Government Gazette No. 129, Act No. 4 of 1979 on Child Welfare, Law No. 23 of 2002 on Child Protection, Social Ministerial Decree No. 41 / HUK / KEP / VII / 1984 Implementation Guidelines for Licensing of Adoption, SE MA No. 3 of 2005 on Adoption, and so on. While reviewing court case approach adoption petition in the district court and the religious court in Banten. Adoption contain any aspects of the legal protection of the adopted child as legal protection of children in general. Child protection Efforts can be Divided into direct and indirect protection, and if the review of nature protection, child protection can also be distinguished: the juridical protection, including protection in the field of civil law and criminal law; and protection of non-juridical, including in the field of social protection, health and education.
