  • The access to obtain information is one of the human rights that had been guaranteed in the Indonesian Constitution of 1945 and implemented in the Act No. 14 of 2008 on Public Information (called UU KIP). The Freedom of Information Law (UU KIP) provides a strong mandate to the Commission of information that includes aspects of policy (policy), regulation (regulatory) and dispute settlement (adjudication). But institutionally, UU KIP does not guarantee the independence of the process in terms of the Appointment of Members (Commissioner), secretarial support, and budget which is decentralized. There are two (2) problems posed in this study, namely (1) how is the position and function of the Provincial Information Commission to solve the dispute of public information? (2) How is the implication of the appointment of members, secretariat and budget of the Commission information that is decentralized to the independence of the Provincial Information Commission. The theory used in this problem is the theory conceptualized a state of law and theory of state institutions, in this case the theory of self or independent institution. This study uses normative juridical approach, i.e. legal norms conceived as autonomous and separate from social factors, as well as focusing on the research of the law book. The data used is primary data, secondary data and tertiary data. Based on the research, it can be concluded that the Information Commission consists of the Central Information Commission, the Provincial Information Commission and the Information Commission in District/City when needed. Information Commission runs the Freedom of Information Law, implements the regulations, and establish technical guidelines and standards of service Public Information to resolve the disputes through mediation and/or non-litigation adjudication. The mechanism of appointment of members of the Information Committee, secretariat and budget that are decentralized and varied in each province, have a significant implication for the inhibition of the process of implementation of tasks and functions of the Provincial Information Commission, including in the dispute resolution process of public information
