- ABSTRACT ANGGA BUDI SAPUTRO, NIM: 122121008 “ANALYSIS OF THE JUDGE‟S DECISION TOWARDS MARITAL PROPERTY DIVIDING IN EVENT OF DIVORCE” (a case study at Surakarta Religious Court in the year of 2015). Marriage is god‟s creatures‟ nature behaviour to increase the numbers well. Marriage is not only for human but also for plants and animals. Thus, human is a thinking animal, marriage is one arranged culture to follow the human‟s culture development in society. According to the problems above, this research has a purpose to find how juridical and Islamic jurisprudence‟s view in accomp lishing marital property dividing in event of divorce in the case number: 0659/Pdt.G/2015/PA.Ska, and number: 0013/Pdt.G/2015/PA.Ska about marital property dividing. This research is to find out the consideration and the cause of action which the judge used in the case as well. This research is a field research which has a direct observation to get the information needed in arranging the data in Surakarta Religious Court. The result of this research is based on Act number 1 of 1974 and Compilation of Islamic Law article 97. This case of marital property could decide of each husband and wife‟s own property as well. The properties could be movable and immovable assets, and/or negotiable instruments.this marital property is ruled on Act number 1 of 1974. Those explanation above related to 2 (two) decision of Surakarta Religious Court in the year of 2015. The first decision is the court judgement number: 0659/Pdt.G/2015/PA.Ska, deciding marital property between Mrs. Titik Sugiyati binti Soegiman Gito Raharjo (Plaintiff) with Mr. Drs. Sudjini, S.Sos.,M.Si bin Parto Ijoyo (Defendand). The second decision is the court judgement number: 0013/Pdt.G/2015/PA.Ska deciding the marital property between Mrs. Intan Pradita binti Suparmo (Plaintiff) with Mr. Rusmanto bin Karsam (Defendant).
