  • The implementation of death penalty in Indonesia is still a topic of debate among legal thinkers. For those who contend with death penalty, it is contrary to the constitution and human rights. As for the death penalty, it is argued that it is a proper form of punishment for the perpetrators of serious crimes such as drug trafficking, premeditated murder, gross violations of human rights, and various crimes that have a wide negative impact on society. The existence of death penalty has also received legal recognition through the decision of the Constitutional Court which considers that death penalty is not contradictory to the constitution and human rights values.
