- This thesis is written to explain those who took the responsibility due to work accidents of the outsourced worker in a workplace who are not registered to Social Security Program and also written to explain sanctions to the outsourced company due to a work accident of the outsourced worker. One of the worker’s rights is to get social guarantee in the form of occupational health and safety. The institution in Indonesia which authorize to provide medical coverage program is Social Insurance Administration Body. It has two types of insurance, such as Healthcare Social Insurance and Social Security Program. Every company which based in Indonesia must registers all of it’s worker to Social Security Program which covers Old Age Protection, Working Accident Protection, Death Protection, and Pension Protection. But not every company has registered it’s workers to the social security program. So that, there’s an violation of worker’s rights. There are two parties which have to take the responsibility due to work accidents of the outsourced worker who are not registered to the Social Security Program, it depends on each parties violation. This thesis is written using normative juridical.
