- In the world of capital markets, securities trading is one instrument that has its own charm, so that the public interest is so great to invest funds in securities. Securities Broker-Dealer to trade with a variety of purposes, the end result is profit. One strategy is to profit by short selling. Indonesian Clearing and Guarantee Corporation (KPEI) provides securities lending and borrowing facilities for the broker to conduct transactions such short selling. Agreement Securities lending and borrowing have differences with lending agreements in general. There are specific clauses in securities lending and borrowing agreements, the clause giving authority for the owner to transfer legal ownership of securities with the status of the loan. Agreement Securities lending and borrowing is not as Civil Code regulating lending agreement. The aim of the authors in the preparation of this thesis is to find out what special clauses contained in treaties such Securities lending and borrowing as well as how the status of securities lent to the borrower in view of the Civil Code and the Regulations relating to Regulatory Invitations in the capital market.
