  • The purpose of this study are to discuss the contractual aspects of the utilization of land owned by the Village which includes the purpose of implementation of the Village Land use, forms of contracts and the principles of the existing contract or contracts must be implemented in the establishment of Village Land utilization. Land owned by the Village is one of the village wealth that can be utilized to increase the village income. The management and utilization of land owned by the Village at possible is done by a third party. Status of rights attached to the Land Use Right's Village is a term that is not owned by the village government so as not to be caused by the transition of the rights to the land owned by Village. Village Land Utilization done by the village chief with the approval of BPD in order to capitalize on the Village property and increase real income of the village. Form - form the legal construction of exploiting the wealth of the village is a lease, lend use and joint utilization. Principles that need to be noticed in the utilization of this rural property is functional principles, legal certainty, transparency, efficiency, accountability and certainty of value. In establishing the village's land use contract that needs attention from the government other than the purpose is to make use of village land that is owned by Village to raise revenue and for the prosperity of village communities also need to be noticed also that the interests of investors to seek profits for such contracts is commercial contracts. Thus, in the formation of an important contract stage is the stage of pre-contract or negotiation because in this phase will reach an agreement that will put in the form of contract must be executed by the parties.
