  • This conference paper describes the state-of-the-art- of author right in Italy and the situation of emergence of the Italian libraries because, as a consequence of the recent new legislation, they are not able to provide the right of access to information for their user. While in other countries – where there are other laws – this right is asserted by the constitution, the Italian libraries are considered at the same level of the centres for copies. This paper focuses on the modifications to the law 248/2000. In our current system, called “of author right” but actually privileging the owners of rights and not the author, libraries are regarded as “exceptions” and, thanks to this label, they are allowed to provide access to information within the borders of a “grey area” called “libere utilizzazioni”. These free areas have been abruptly reorganized and the situation now is not so reassuring.
