- Considering the various interlocutions between Brazil and France in the archival context, this communication aims to present a comparative study on the Brazilian and French Archives Law in order to analyze the practices of both countries, especially with regard to the guidelines of treatment, access and preservation of private archives. To do so, we proceed to the documentary research method. The study comprised, in a more specific way, policies on private archives in Brazil and France, especially regarding the legal aspects related to this type of collection. Thus, it was observed that the Brazilian legislation was based on French practices to draw up guidelines for the private archives in the Country, which allows to conclude that just as in France, in the Brazilian context, it is possible that these documentary sets are declared of interest public and historical and that these actions happen according to the specificities of each of the countries.
