bekerja sama dan saling membantu untuk menata kota. Tidak terkecuali, apakah
dari pemerintah ataupun dari masyarakat Bali sendiri, termasuk juga masyarakat
desa adat Sukawati, kecamatan Sukawati, kabupaten Gianyar. Sebagai daerah
tujuan wisata, maka akan banyak para wisatawan lokal dan asing berdatangan ke
propinsi Bali, sehingga akan berpengaruh kepada meningkatnya kebutuhan tanah
untuk dijadikan obyek wisata. Dahulu, tanah-tanah di Bali merupakan sesuatu
yang sakral dan merupakan suatu kesatuan dengan jiwa masyarakat. Dalam hal
pemanfaatan tanah, masyarakat Bali selalu menghubungkannya dengan hal-hal
religius dan hanya dipergunakan untuk tempat tinggal serta untuk keperluan adat
saja. Akan tetapi, karena kebutuhan tanah semakin meningkat dikarenakan
pengaruh kepariwisataan, hal-hal di atas semakin lama semakin ditinggalkan.
Apalagi pengaruh kebutuhan ekonomi semakin meningkat dan bergesernya pola
pikir masyarakat Bali khususnya di Desa Sukawati.
Metode yang dipakai penulis dalam penelitian ini menggunakan
metode penelitian Yuridis-Empiris dengan metode pendekatan Diskriftif-Analisis.
Untuk pengumpulan data dan bahan hukum primer dan sekunder, diteliti melalui
pengamatan langsung ke lapangan, melakukan wawancara baik terstruktur
maupun tidak terstruktur dan mempelajari dokumen-dokumen hukum dan normanorma
adat serta menggunakan metode observasi. Adapun analisis data, tehnik
yang dilakukan secara kualitatif.
Dalam pelaksanaan pengalihan fungsi tanah adat menjadi obyek pariwisata
di Desa Sukawati, Kecamatan Sukawati, Kabupaten Gianyar ini, dilakukan
dengan cara jual beli atau sewa kepada para investor. Untuk menentukan
dialihkan apa tidak harus melalui musyawarah semua perangkat desa..Terjadinya
pengalihan fungsi tanah adat ini karena factor ekonomi dan factor perubahan pola
pikir masyarakat Akan selalu terjadi, untuk membuat suatu peraturan baru, pasti
ada yang setuju dan ada yang tidak setuju dan mendapatkan hambatan. Demikian
pula dalam hal pengalihan fungsi tanah adat menjadi obyek wisata di Desa
Sukawati, hambatan utama adalah datang dari golongan orang tua yang takut
terjadi malapetaka apabila tempat-tempat pemujaan atau tempat sembahyang
dipindah atau dibongkar. Akan tetapi, dengan pendekatan dan musyawarah yang
baik, hambatan itu dapat ditanggulangi.Namun demikian, ada hal-hal yang
memang harus dipertahankan dan tidak boleh dihilangkan, yaitu mengenai
tempat-tempat ibadah/pura yang tetap harus dijaga keberadaannya.

Bali is a tourism destination city. As the tourism destination area, it’s a
necessity for entire part of supporting elements to cooperate and participate to
manage the city in order to fulfill the purpose. Including all elements of
governmental and social order, especially the society members of Sukawati
custom village, Sukawati Sub-District, Gianyar Regency. Within the matter, there
will be plenty of local and foreign tourists visiting Bali Province, in which the
land for tourism purpose would be required more than ever. Years in advance,
lands in Bali was considered sacral and as the unity of people soul. Upon the land
exploitation, Balinese always relates it with religious matter and only uses it as the
shelter and above matters were placed behind. Moreover, the financial pressure
increases gradually and the phenomenon of the thinking pattern shifting of Bali
society especially in Sukawati Village holds.
The research used juridical empirical with the approach method of
descriptive analytic. For the data collecting and the primary and secondary law
material, the research used field direct observation, through interview both
structured and non-structured, and examining law documents and custom norms
and by using observation method. Whereas, the data analysis, the research used
qualitative technique.
Upon the execution of the function Conversion of custom land to be the
tourism object in Sukawati Village, Sukawati Sub-District, Gianyar Regency, it
was executed by trading or renting to the investor. To determine the conversion, it
should pass meeting of the village officer. Because of the financial pressure and
the shifting of people thinking pattern it will always be happened, for making a
new regulation, there will be the agree and the disagree side, and will cause
obstacles. Within the matter, the risen obstacles come from the old generation,
which believes on the disaster coming, concerning to the relocating of the praying
shrine and the holy place. Nevertheless, by the fine persuading and meeting, the
risen obstacles could be overcome completely. However, there is the prevented
and not allowed to diminish, which is upon the holy shrine that should be
