  • This study aims to determine and analyze legal deed of agreement binding sale and purchase of land and buildings are carried out by the Notary and PPAT in the city of Padang. In practice, buying and selling occurred preceded by the binding with the aim that the certainty of the law against the parties who participated in the purchase agreement of land and buildings, that the parties would later realize the actual buying and selling for some time or later after the binding agreement signed to handle. That is, this is a binding agreement that precedes the purchase agreement of land and buildings. that must be done before PPAT (Land Deed Makers Acting). In this regard, the author of more focused research on this issue relating to "what factors led to the binding sale and purchase of land and buildings, how the power of binding deed of sale proof made before Notary and how the event of default in the agreement binding buying and selling land and buildings which have been held before Notary. In an attempt to obtain the data used in solving problems of juridical approach of empirical, descriptive studies, and research results can be considered as the implementation of agreements binding sale and purchase of land and buildings carried out before the Notary and PPAT. Based on this conclusion in the can by the author which is the basis of the transaction agreement in the sale and purchase of land and buildings referred to as binding. Therefore the agreement object is land and buildings, then it becomes the authority in the Notary deed covenant, while the right shift is done through an in PPAT designated by their respective working areas, here the authors refer to the Notary and PPAT in the city of Padang. In Article 37 paragraph (1) Government Regulation No. 24 of 1997 on Land Registration. can be seen that for the transfer of land rights required an authentic deed made by a public official who called the Land Deed Makers Officials (PPAT) is appointed by the government. Public officials as dimakusdkan is Notary and PPAT. so that the transfer of land rights can not be done away without fulfilling the requirements established by legislation in force. The agreement is intended as a binding preliminary agreement of the main intentions of the parties to make the switch right on land and buildings.
