- R-esearch on "Analysis of the Commission's Decision Regarding No.25lKppUIl20A9 Fuel Surcharge and Damages against Nine Airlines in Case Violation of Law No. 5 Year 1999 conceming Prohibition of Monopolistic Practices and Unfair Competition" aims to find and analyze calculating benchmark fuel surcharge and administrative sanctions against compensation for the nine airlines No.25lKPpIJ-ll211g KPPU decision. This research is a normative legal research using descriptive analytical methocl. Secondary data obtained through library research, done by finiing and collecting and researching library materials which are second ary data relating to iesearch the title and subject matter. The results showed that in case the Commission No.25/KPPU-I/2009 about fuel surcharge is there a different interpretation of the regulation framework as the benchmark to determine the amount of fuel surcharge, so there is no uniformity in the determination of the amount of fuel surcharge by airiine compalies and difficult for the Government to control the amount of the fuel surcharge that occurs in the market. Calculation of compensation to the administrative sanctions set by the Commission, must have a clear guideline calculation based on a foundation of accurate and based on the element of prudence. So the impact on the jurisprudence issued by the Commission regarding the determination of cornpensation payments resulting in ciarity to achieve a principle of legal certainty.
