Research done by researching the legal norms contained in the legislation that applies attributed to the fact that there is in society by using normative legal research ie research that refers to the legal norms contained in the legislation. Research is also conducted by the method of empirical research to find out the workings of law in society relating to the ineffectiveness of the legal issues in order to arrange the legal order or to manage and control the development of society. According to the legal owner of cell phone numbers used by the customer is the customer itself, while the cell phone number owner is the State which have expired. Protection of customer privacy rights have occurred since the agreement took place so that the actions of mobile telecommunications services operator who sent the SMS to the customer without any approval and / or previous agreement is an unlawful act. Privacy protection stipulated in Law no. 36 of 1999 on Telecommunications was limited to wiretapping restrictions and confidentiality of information, while confidential personal data, confidential customer on a cell phone number and the prohibition against acts of the operator or third party's privacy, not regulated at all.
