- This research was aimed to find out the role of notary in the implementation of foundation establishment certificate making based on regulation number 28 year 2004 about foundation in Yayasan Satunama Yogyakarta. This is an empirical juridical and normative juridical research, comprising of field research and library research. This research was carried out in Yayasan Satunama Yogyakarta. The primary data was taken from interview with the respondents and source persons. The respondents in this case were notaries making sc in Yayasan Satunama Yogyakarta and the organs of Yayasan Satunama Yogyakarta. Meanwhile, the source persons in this case were notaries who made establishment certificate. The secondary data was obtained from library research, comprising of primary, secondary, and tertiary law materials by using documents study. The data obtained was then processed based on qualitative analysis and presented in descriptive form. Based on the research result, it is found out that: (1) the role of notary in the implementation of foundation establishment certificate making based on regulation Number 28 year 2004 about foundation in Yayasan Satunama Yogyakarta covers three important things, explaining the requirements in the making of foundation establishment certificate to the founders of the foundation, making its establishment certificate, then proposing the approval to the Minister of Law and Human Right. (2) The responsibility of the notary for the establishment certificate of Yayasan Satunama Yogyakarta is that the notary is responsible for the truth of the formil and materials contained in the foundation establishment certificate he or she made, and the notary is also responsible to propose the approval of foundation establishment certificate to the Minister of Law and Human Right to get legal institution status.
