- The aims of the research are to find out whether the requirement in Act No 5 Year 1999 concerning Exclusion of Monopoly Practice and Unhealthy Business Rivalry has protected minor business, and effort can be carried out in law protection for minor business subject toward retail modern market growth especially in Sleman District of Yogyakarta. This research is normative juridical, means that this research based on secondary data, primary data, and tertiary data. Secondary data obtained through literature research while primary data found from field research. Field research is conducted by interview while to get secondary data carried out by documentary study. Then this research result analyzed qualitatively that is the data found from respondent by written or verbal notices and also the real behavior and researched and learned as the complete work. This research finding shows that requirement in Act No 5 Year 1999 concerning Exclusion of Monopoly Practice and Unhealthy Business Rivalry is not found the direct requirement which aim to minor business protection, however several requirements which support the minor business protection are: a. consideration, in line with Chapter 33 of 1945 constitution, that is economical democratic and No 5 Year 1999 which in essential
