- This research aims to determine and explain the implementation of musyarakah mutanaqisah contract in financing the syariat residence, determining the cause factor for customer of default and effort for its completion to Bank Muamalah Indonesia in Cianjur branch. This research uses empirical juridical research method that is research which conducted to obtain primary data concerning to existing condition in the field and the materials related to research subject as secondary data. Primary data obtained through interview with the respondent and the competence source of information on Bank Muamalat Indonesia in Cianjur branch whereas the secondary one obtained through literature study. The data collected will be analyzed qualitatively therefore obtained explanation about the problems discussed. After implemented the analysis obtained the findings are: (1) the implementation of musyarakah mutanaqisah contract in financing syariat residence on Bank Muamalat Indonesia in Cianjur branch in the process is divided into 2 (two) group based on financing value, they are firstly based on financing value over Rp. 250.000.000
