- Fast growth in banking industry forces bank to compete by offering various products and services. This study discusses the application of the prudence principle in lending at Panin Bank in Yogyakarta. This study aims to determine the credit at Panin Bank by applying the precautionary principle and to know the resolution of loan problems by Panin Bank. This study is ajuridical empirical research, namely the approach to the problem by looking at and consider the applicable legal norms associated with the existing phenomena of the problems encountered in the study. This study uses a type of library research using secondary data derived from the legal materials relating to this research and also field research by collecting data on the primary form of information directly obtained on the study site. Sampling using a nonrandom sampling technique to the type of respondents selected a purposive sampling is taking on the subject based on the characteristic or specific nature which is closely related to populations that have been previously known. Granting credit to customers is one way banks can be said to exist in the banking industry. But often it's less lending to the principles of existing banks. Precautionary principle is one of the principles of the most often overlooked in giving credit. Implementation of the Panin Bank lending has been implemented in accordance with the procedures and regulations by adhering to sound credit granting guidelines, but in the field pelaksanaanyan there are some constraints so that the use of 5 C in the analysis of credit can not be implemented optimally, so that the unavoidable occurrence of credit crunch. And to deal with problem loans arising from the use of Bank Panin model settlement with problematic credit rescue through rescheduling, reconditioning, dan restructuring, and settlement of credit through a peaceful settlement by selling the collateral under the hand and settlement through the legal channels are implemented by KPKNL (Office of State Property and Auction).
