- Therapeutic agreement can be defined as agreement between doctors or hospitals and patients to implement a series of attempts or recovery treatment toward the patients. The research aimed at identifying the implementation as well as obstacles faced in therapeutic agreement between hospitals and patients in Rumah Sakit Islam Yogyakarta (RSIY) PDHI. The research belongs to juridical empiric legal research, which analyzed the implementation of therapeutic agreement between hospitals and patients in RSIY PDHI. The research involved 18 respondents. Then, primary data obtained from field and library study were analyzed qualitatively and presented descriptively. Based on the research results, the implementation of therapeutic agreement in RSIY PDHI has not gone optimally. In written informed consent imposed by RSIY PDHI, there are clauses establishing about the risk transfer of medical treatment from the hospital to the patient. This stipulation is in conflict with Article 17 clause (1) Ministry of Health Regulation No. 290/MENKES/PER/III/2008 on Agreement for Medical Treatment as well as Article 18 clause (1) Act No. 8 Year 1999 on Consumer Protection. Meanwhile, there are obstacles in the implementation of therapeutic agreement from the hospitals, such as several doctors who frequently do not fulfil their duties to fill in the medical record documents completely, such as do not write the diagnoses results of the patients. Whereas, the obstacles also come from the patients, which are in the form of their attitudes that can not understand the information given by the doctors due to patients� low educational background
