- The authority to manage a notary protocol from another notary which has reached 15 years or more is held by the registrar of district court. The authority has expired along with the withdrawal of Law of Notary (peraturan Jabatan Notaris) which has been replaced by the new Law of Notary (UU Jabatan Notaris). The authority to manage a notary protocol from another notary which has reached 25 years or more is held by the district surveillance council (majelis pengawasan daerah). But until today the registrar of the court district still accepts application to issued copy of certificate. Therefore the writer's focus is doing research based on this matter under the title "the transfer of authority to manage notary protocol after the New Law of Notary" This research is using empirical methods, field research as main data and supporting the findings with literature and documents. Data from resource persons is included as primary data and literature and documents as secondary data. The results of this research are: (1) Since there is no response from the Law and Human Rights ministry on to the letter issued by the registrar of district court Yogyakarta related to the transfers of authority to manage notary protocol and the demands of society to apply for the copy of certificate, therefore the copy of certificate issued by the registrar of the district court only functions as help for the society in need. (2) The copy certificate issued by the registrar of district court of Yogyakarta is not legal because the legal ground that give them the authority had been replaced by the New Law of Notary, therefore their authority has been withdrawn. (3) District Surveillance Council has the same duties and authorities as a notary in managing its own notary protocol such as maintain the notary protocol, grosse acte, copy of certificate and quotation of certificate. Limited means and infrastructure are the main obstacles for the district surveillance council to make a physical transfer of notary protocol in the Yogyakarta district of court. Therefore the district surveillance council in Yogyakarta has not been able to do its functions related to managerial of notary protocol.
