- This research is aimedto determinethe process of grantingand execution of mortgagecredit agreement with Bank X Yogyakarta performed by inter-racial marriage couple where the husband or the wife has a foreign nationality, what obstacles there are in the process of granting and executing of loan agreements with the mortgage, and the efforts of Bank X Yogyakarta to overcome the obstacles in the credit agreement with a mortgageby a couple who perform an interracial marriage between Indonesians and foreigner The data whichis used in this researchis secondary data whichis obtained from library materials through the study of documents upported by primary data.The primary data is obtained directly from the field interviews using interview guide data collection form. The data collected were analyzed qualitativelyand presentedin the form of research reports with descriptive method. Basedon the researchconductedby the writer,it is known that the Bank's analysis of credit applications where the loan applicant has a foreign spouse shouldhave a precautionaryprincipleto minimi7.ethe risk by examiningthe rules relating to the subjectsthat are authorizedto act on the object securityof law, indepth analysis of the security object itself, and the presence or absence of the Maniage Covenant. Moreover, the obstacles occur in the process of credit grantingon credit applicantswho have foreign spousesis on the ownershipof the shared property as it is related to Article 21 paragraph (3) UUP the shared property owners who do not meet the requirementsof this Article is obliged to terminateits ownershipin within one year.Thus it will not be executed,the rights of the land would be ownedby the state entirely.The efforts which are made by Bank X Yogyakartato overcomethe obstacleshappen are to ask land holder to convert the status of the right towards the land into '"TheLand Use Righf'. This option is necessarilyimplied if the Bank has a very strong convictionof certain debtors who have an excellent track record in the realm of credit, and also in considerationof the benefits that will be obtainedby the bank from the supplyof loansto start businessactivities.
