  • The objective of this research is to analyze the form of execution upon an object of fiduciary guarantee that was chosen by Astra Finance Company in Yogyakarta in order to protect its legal interest in a consumer finance contract. This research is juridical empirical research that is a field research strengthened by Library research.The obtained data were primary and secondary data. Primary data were obtained from field research through interview with respondents and resource person. Meanwhile, secondary data were obtained from the substance of the primary, secondary, and tertiary law through library research. This research used non random sampling method, that iswas not all population were given chance to be the sample, while the technique of sample intake was purposive sampling method. The result of the research shows that the form of execution upon an object of fiduciary guarantee that was chosen by Astra Finance Company in Yogyakarta in order to protect its legal interest in a consumer finance contract is underhanded sale but the procedures do not completely follow the formal procedures. It is stated that there was not any announcement in the newspaper. Based on this analysis then underhanded sale which is conducted by Astra Finance Company in Yogyakarta is a new form of underhanded sale which is not stipulated in regulation because the procedures are totally arranged by the Astra Finance Company as a creditor. Concerning that phenomenon, there is a sign for the birth of a new form of underhanded sale in creditor's version. Keywords: Form of execution, an object offiduciary guarantee, consumer finance
