- Abstract The House of Representative has made Amendments to the 1945 Constitution of the Republic of Indonesia for four times. In the fourth Amendment, The House of Representative in Additional Provisions, Article II stated that with the enactment of this Amendment to the Constitution of the State of the Republic of Indonesia shall consist of the Preambles and Articles. This enactment does not practically eliminating the existence of the Elucidation of the 1945 Constitution. This uncertain decision of the House of Representative leads to the ambiguity of the existence of the Elucidation in law. Key words: Existence -1945 Constitution Elucidation
