  • This research is a normative juridical research, intended to find out how is government effort to protect cigarette consumers and how is cigarette producer responsible to the cigarette consumers in Indonesia. This research conducted on cigarette consumer samples including 2 (two) cigarette consumers who claimed via letter and 4 (four) cigarette consumers via telephone in Indonesia Consumer Protection Foundation (YLKI), cigarette producers respondent samples including FT Philip Morris, PT British American Tobacco, FT HM Sampoerna, FT Djarum Super, FT Gelora Djaja, and FT Djirak, and also The Board of Drug and Food Control (Badan POM) as government respondent. Samples were chosen from purposive sampling. This research shows that until this time, there is no a government effort to protect the cigarette consumers totally yet in Indonesia, although the law of protection to the cigarette consumers has been arranged through by some regulations, like : Broadcasting Law 1997 changed by Broadcasting Law 2002, Consumer Protection Law, Press Law, and government regulation about Cigarette Control for Health. The Board of Drug and Food Control (Badan POM) also Departement of Health has no authority to punish. Most of the cigarette producers refused their responsibility to the cigarette consumers related with consumer right to get an information about the product and consumer right to safe product according chapter no. 4 Consumers Protection Law, like : no stick label of tar and nicotine level in cigarette pack, breaking cigarette advertisement law, and produce high tar dan nicotine cigarette that actually they can produce lower.
