- This study aims to identify the barriers to filling a patent application that is experienced by researchers and institutions (BATAN) and solutions to these obstacles. Another goal is to determine the level of legal awareness of researchers in applying for a patent. This study is a socio-juridical law, namely the identification of research that examines the legal aspects and the effectiveness of the law. Data obtained by library research to obtain secondary data. This data was further supplemented by field research. This results showed that: (1) In institutional BATAN have problems in terms of budget constraints, lack of human resources is the focus of care of IPR and patent filing procedures are poorly understood at level unit. The solution to these obstacles is done with the use of information technology, socialization patent issues and procedures, also monitoring and evaluation of the development of the existing patent filings. Budget increase and strengthen coordination with parties related to the patent filing. (2) Barriers experienced by researchers BATAN including understanding the procedure of filing a patent that has not been evenly distributed, technical issues related to patent drafting, and budget constraints are used for management and maintenance of patent. The efforts made by researchers of BATAN among others conducting research funded another party requiring the filing of a patent, and strengthen cooperation with fellow researchers and managers Sentra IPR in terms of solving the technical constraints of the patent filing. (3) Legal awareness is still low BATAN researchers evidenced by the absence of the filing of the patent application of the respondents (20 researchers).
