- The background of this legal research on the legal protection for labours based on Law of Labor No. 13/2003 (case study of the labors in Agung Saputra Tex woven fabric company) was motivated by the condition of labors rights and benefits in Agung Saputra Tex woven fabric company which were not fulfilled by the owner of company. The labors question for their working status in the company, because they have clear, they are considered as wholesale workers (pekerja borongan). They also never get any Religious Holiday Allowances (Tunjangan Hari Raya/THR) which it is the company�s obligation. The workers are also not engaged in Workers Social Protection Program (Jaminan Sosial Tenaga Kerja/JAMSOSTEK), there are no protection for the workers if any work accident happen. In this legal research, there are two main problems. First, how do agung saputra tex woven fabric company fulfill their labors right in the term of legal protection? Second, what kind of resolution efforts that may be taken if there are any industrial relation dispute between the workers and the agung saputra tex woven fabric campany? This legal research is using the empirical legal research, which writer had to examine secondary data at the baseline, and then continued with the examination of primary data on the location or to the society. The data analysis that used is qualitative methode, which presents the data descriptively, and analyze them qualitatively.In running the bisiness, Agung Saputra Tex Woven Fabric Company is not fully giving the legal protection comprehensively yet, based on the Contracts and the positive Law related to workers right in Indonesia. The company�s workers finally take legaal action to fight for their rights, through the settlement of industrial disputes based on Law No. 22/2004
